Is Patching a older client illegal? I was trying to find out how and was told it was?

It is not illegal to send a custom patch. It is illegal to redistribute the Ultima Online client and their artwork is copyrighted as well.

Go by whichever you prefer, then. I'm speaking from sources on this messageboard that I've read over the months. Personally I'd follow whatever one of the mods here says.

whether you can, or whether you can legally are two different things.
Khaz is telling you what is legal, mr fixit is telling you what is possible. Distributing the actual UO muls and executables provided by EA is a copyright violation as Khaz said, while patching them, or distributing patches for them, and using them to access free servers is not.
